Terms and Conditions of use of the digital channel
PHOTOGRAPHY PERU, also referred to as the Company in this document, wants you to fully enjoy your vacation in Peru. Therefore, we recommend that you carefully read and follow the instructions of your sales agent.
PHOTOGRAPHY PERU is considered one of the safest agencies in Cusco.
Please read the following conditions carefully, as they constitute your contract with PHOTOGRAPHY PERU. By booking a trip with PHOTOGRAPHY PERU, you agree to be bound by these Terms and Conditions, which describe, among other things, our cancellation policy and certain limitations of liability at the time of booking.
The quote we provide will be valid once the booking is confirmed. From that point on, you may ask any questions regarding your vacation. PHOTOGRAPHY PERU will be happy to answer all your questions. Quotes do not apply to international flights to and from Peru. If you would like us to assist you with international or domestic flights within Peru, the flight must be paid for immediately and purchased on the same day or, if possible, the following day to ensure the offer’s validity, as prices fluctuate daily.
Our prices do not include meals not specified in your itinerary, personal expenses, personal insurance, or baggage handling.
The Contract
The contract is between PHOTOGRAPHY PERU (also referred to as the Company) and the Client, who is the individual traveling or intending to travel on a tour operated by the Company.
You, the Client, are subject to having read and understood our travel policy as outlined below. By making a reservation by phone, through the website, or by email or fax, you agree to and are bound by these Terms and Conditions. These Terms and Conditions constitute the entire agreement between the Company and the Client regarding the subject matter hereof and are legally binding.
There is no oral or written representation, warranty, guarantee agreement, prior agreement, description of services, or any other terms and conditions or promise of refund not expressly stated herein. The service to be provided is/are the tour(s) mentioned in the booking confirmation.
These conditions apply only to the services in our program and not to international or domestic flights. These are subject to the terms and conditions imposed by the airlines.
Securing Your Booking
To guarantee your booking, PHOTOGRAPHY PERU requires a completed booking form (either the one on our website or the one we send with your quote), along with the required deposit payment. The ideal time to make your booking is 30 days before your trip to Peru. A booking is accepted and becomes final only upon receipt of your deposit, at which point a contract is established. PHOTOGRAPHY PERU reserves the right to refuse any booking at its discretion.
Customer Information
To confirm and guarantee the arrangement of your trip, you must provide all your identification information with your initial payment or no later than 30 days before the start of your trip. Customer information includes passport number, a copy of your passport details and medical form (if applicable), full name, date of birth, international flight information and nationality, and a landline or mobile phone number for emergencies.
Final Payment / Surcharges
In order for the company to confirm and guarantee the arrangement of your trip, you must provide all your details with your final payment at the start of the tour.
Surcharges: To avoid surcharges on your vacation, please book in advance and do not change your hotel at the last minute.
If you change your booking
A US$50 administration fee per person will be charged if your confirmed booking is changed or transferred to a different departure date or tour up to 30 days before your trip. After that time, all changes will be treated as cancellations and subject to the charges as follows.
If a client is unable to travel and notifies us approximately 20 days in advance, under circumstances deemed reasonable by PHOTOGRAPHY PERU, the reservation may be transferred to another suitable person, or their money will be refunded less 20%, as 10% is used for money transfer fees and the other 10% covers administrative costs. The refund will be processed within 15 days.
Changes
The company reserves the right to modify any of the facilities, services, or prices described in the brochure or website. If such a change is made, the client will be informed at the time of booking or when the change occurs. While the company will strive to operate all tours, reasonable changes to the itinerary may be made when deemed necessary or convenient by the company due to external factors beyond its control.
Cancellation Policy – Right of Withdrawal
Confirmed reservations are subject to the following cancellation policy:
- Cancellations or changes to paid reservations will incur a penalty of 50% of the total package price and must be made within a maximum of 60 calendar days after the request is received.
- Cancellations or changes made between 8 and 1 days before the departure date will incur a penalty of 100% of the total package price.
- Airline tickets for commercial airlines or charter flights included in the booking are non-refundable. In case of cancellation, the tickets will remain in the name of the booking holders, who may use them within one year, paying any applicable penalties and fare changes at the time of use.
Complaints
If the client has a complaint about any of the tour arrangements, it is a condition of the contract that they inform our local representative at the time of the complaint. If the complaint is not raised at that time, or if PHOTOGRAPHY PERU later denies us the opportunity to investigate and rectify the problem, PHOTOGRAPHY PERU cannot accept any responsibility. If the client has a dispute with PHOTOGRAPHY PERU and cannot resolve it, please write to us within 28 days of their return, and we will investigate further.
Travel and Cancellation Insurance
Travel insurance is highly recommended for all customers booking. We recommend that it cover personal injury, medical expenses, repatriation costs, evacuation costs, cancellation, and reduction of trip expenses. It is our policy to verify the validity and coverage of your insurance policy, and we reserve the right to refuse transport to anyone whose insurance does not meet these criteria. If you choose not to purchase travel insurance, you will be required to sign a waiver acknowledging that insurance is recommended but declined, and that you may request a change or cancellation if necessary.ación de su viaje o si incurrió en gastos tales como gastos médicos, que el cliente será responsable de todos los costos adicionales tales.
Medical Form
For insurance purposes, all clients are required to complete our PHOTOGRAPHY PERU form, which must be signed and dated by a practicing physician (if there are any pre-existing conditions) and sent to us no later than 15 days before the start of your trip.
Financial Security
PHOTOGRAPHY PERU is a travel agency accredited by the Ministry of Tourism and registered as a corporation with the Peruvian Ministry of Tourism. PHOTOGRAPHY PERU complies with current European regulations regarding the protection of client funds.
Client Responsibility
The client agrees to accept the authority and decisions of PHOTOGRAPHY PERU employees, tour leaders, and agents while on vacation. If, in the opinion of these individuals, a client’s health or conduct at any time before or after departure appears to jeopardize the safety, comfort, or tranquility of the tour, the client may be excluded from all or part of the tour.
Clients must be in possession of their respective identity documents and are responsible for carrying a valid passport with a visa, if applicable, and the required vaccination certificates for the entire duration of their trip. Their passport must be valid for six months after the return date.
Our Responsibilities
Bookings are accepted with the understanding that clients appreciate the potential risks inherent in adventure travel and that they undertake the visits, excursions, or expeditions listed in our programs at their own risk. It is also important to understand that even the most meticulous arrangements can go wrong.
The company is committed to providing its services with due diligence to ensure the entire trip runs smoothly, and we will strive to provide you with the best possible service.
The Company assumes no responsibility for force majeure, weather phenomena or natural phenomena that may occur before or during the trip, or for any eventuality that may make any trip uncomfortable or difficult, or for any delay or obstruction of your trip in any way and does not guarantee failure on the part of the company, either for the total or partial execution of the provision of the services that the Company has committed to provide which may have been affected by the aforementioned factors.
Flights / Delays
We cannot accept any responsibility for cancellations or delays of any of your flights if the cancellation or delay is due to adverse weather conditions, airline rescheduling, airport authority and/or air traffic control actions, mechanical failures, or industrial action.
Our company will strive to resolve your travel itinerary and ensure that any inconvenience is addressed and nothing is affected by flight delays.
The client must understand and be flexible if problems cannot be resolved due to flight delays.
Children’s Policy
In all programs, unless otherwise stated, the maximum age for a child is 11 years and 11 months. Children 12 years and older are considered adults and will be subject to adult rates.
Last-Minute Bookings
For all bookings made within 10 days of departure, a fee of USD $50.00 will be charged to the booking file. This Last Minute Fee covers our additional costs for hotel suppliers, train tickets, bus tickets, and operating expenses.
